A managing agent based in the North-West, responsible for approximately 2,000 residential units was instructed by a freeholder to take over the management of eight residential blocks comprising around 800 leasehold units. Following the transition from the previous managing agent, a review of the portfolio identified a substantial volume of historic service charge arrears that required immediate attention.
Having worked closely with Brady Solicitors for almost three years on service charge recovery, litigation support and wider leasehold management matters, the managing agent turned to Brady Solicitors to assist with assessing the arrears position and implementing a tailored recovery strategy.
The Challenge
As part of the onboarding process for the newly acquired portfolio, Brady Solicitors worked alongside the managing agent to conduct detailed block audits across the eight developments. This exercise identified in excess of £200,000 in outstanding service charge arrears spread across more than 100 individual cases.
Recovering the outstanding funds was essential to support cash flow, ensure the continued delivery of services across the developments and provide confidence in the financial position of the newly acquired portfolio. Prompt action was required to prevent arrears from increasing further and to maximise recovery opportunities.
Brady Solicitors’ Approach
Recognising the importance of early intervention, the managing agent instructed Brady Solicitors at the earliest opportunity following takeover of the blocks.
Working collaboratively with the client, Brady Solicitors reviewed the findings from the block audits and developed a tailored arrears recovery strategy designed for the portfolio. Recovery action then commenced across the identified matters, with a focus on early engagement, clear communication and swift progression of cases where appropriate.
The strategy combined Brady Solicitors’ specialist expertise in leasehold service charge recovery with the managing agent’s detailed knowledge of the developments, ensuring that each matter could be progressed efficiently and pragmatically.
Results
The proactive approach delivered strong results within a short timeframe. Within just a couple of months of instruction, close to 60% of the identified arrears had been successfully recovered. Significantly, more than 50% of those recoveries were achieved at the Letter Before Action stage, enabling the client to recover almost £60,000 in outstanding service charge arrears within a matter of weeks.
The early success of the recovery strategy provided an immediate boost to cash flow across the developments and substantially reduced the number of cases requiring more time-consuming and costly legal action. As a result, the managing agent was able to secure a significant proportion of the outstanding service charge funds whilst maintaining focus on delivering a high standard of service across the portfolio.
Beyond the immediate financial recovery, the exercise also provided the managing agent with greater visibility of the arrears position across its newly acquired blocks and helped establish robust processes for managing future arrears cases.
