In a case this week at the First-tier Tribunal (Property Chamber), Brady Solicitors’ MD Clare Brady delivered a powerful result for an RTM client that had been facing tens of thousands of service charge arrears.

The Right to Manage company was dealing with one particularly difficult leaseholder who had applied considerable time and energy into challenging almost every item of expenditure on his service charge statement, from pest control to light bulbs.

The longstanding arrears were running well into five figures and the non-payment was starting to have an effect on the smooth running of the block.

Clare’s strong advocacy combined with the excellent and thorough preparation by the Brady Solicitors FTT team ensured that many challenges were abandoned or withdrawn at hearing, with the Tribunal finding in favour of the RTM company on all remaining major items.

The RTM company can now recover the service charge arrears and get back to managing the block.
